PATERNITY ACTION

A paternity action seeks to do a couple of things; 1. determine if an “alleged” father is actually the biological father of a child, generally through scientific (DNA) testing, and 2. Establish a court order legally holding the father as the legal father.

Our law firm can represent either the mother or the father in a paternity action. The father in the action can be the presumptive father, a putative father, a prospective father, or an unmarried biological father. A paternity action is the first step to determine his rights as to the child.

Once the paternity of a child is proven, then other issues regarding child support, parental responsibility and time-sharing of the child will need to be determined. In some cases, it may be required that a Guardian ad Litem be appointed, a mental health professional, or another third party with specific therapeutic tools, to help establish a relationship between the father and child.
