TEMPORARY CUSTODY


In certain situations, it may be necessary that custody of a child be temporarily awarded to a family member. Florida law allows for such a custody arrangement on a specific basis. A Petition for Temporary Custody by a Family Member must be filed with the Court, and the reasons for the necessity of the temporary custody must be specifically written into the Petition.

In many cases the parents of the child will consent to such an arrangement. However, if one or the other parent does not consent, then a family law judge will make a determination whether the temporary custody to a family member should be awarded.
